This project harmonizes H-2A visa performance data from the U.S. Department of Labor's Foreign Labor Certification Office. The raw data files for fiscal years 2008-2024 were retrieved from: https://www.dol.gov/agencies/eta/foreign-labor/performance and the data for fiscal years 2006 and 2007 were obtained from a previous (and no longer maintained) version of this website: https://www.flcdatacenter.com/CaseH2A.aspx. The final cleaned dataset includes key variables from these datasets with harmonized variable names. This dataset, for fiscal years 2006-2024, is included in the Output folder. Data about applications submitted by employers requesting visas to employ foreign citizens in Cambridge, MA and received by the U.S. Department of Labor through the Labor Condition Application (LCA) and the Permanent Labor Certification (PERM) programs. The LCA program covers H-1B, H-1B1 and E-3 visas.

Each row in the data set represents a single employer application. In the LCA program this application can request one or more positions. Employers can make multiple applications during a single year.

The data available for the H-2A Temporary Agricultural Labor Certification Program is for applications that have been received and entered into the Department of Labor tracking system.

State workforce agencies submit performance data on WOTC certification activities to ETA through the quarterly electronic submission of ETA Form 9058 via the web-based Tax Credit Reporting System (TCRS) of the Enterprise Business Services System (EBSS). ETA 9058 - Report 1- WOTC Certification Workload and Characteristics of Certified Individuals Form, provides state workforce agencies with a standardized e-reporting format to accurately report program activities and outcomes (e.g., certifications, denials, total workload, etc.). Data is aggregated by State.

The data available for the H-2B Temporary Non-Agricultural Labor Certification Program is for applications that have been received and entered into the Department of Labor tracking system.

Context

H-1B visas are a category of employment-based, non-immigrant visas for temporary foreign workers in the United States. For a foreign national to apply for H1-B visa, a US employer must offer them a job and submit a petition for a H-1B visa to the US immigration department. This is also the most common visa status applied for and held by international students once they complete college or higher education and begin working in a full-time position.

This dataset contains five year's worth of H-1B petition data, with approximately 3 million records overall. The columns in the dataset include case status, employer name, worksite coordinates, job title, prevailing wage, occupation code, and year filed.

Acknowledgements

The Office of Foreign Labor Certification (OFLC) generates program data, including data about H1-B visas. The disclosure data updated annually and is available online.
