BackgroundThe COVID-19 pandemic brought global disruption to health, society and economy, including to the conduct of clinical research. In the European Union (EU), the legal and ethical framework for research is complex and divergent. Many challenges exist in relation to the interplay of the various applicable rules, particularly with respect to compliance with the General Data Protection Regulation (GDPR). This study aimed to gain insights into the experience of key clinical research stakeholders [investigators, ethics committees (ECs), and data protection officers (DPOs)/legal experts working with clinical research sponsors] across the EU and the UK on the main challenges related to data protection in clinical research before and during the pandemic.Materials and methodsThe study consisted of an online survey and follow-up semi-structured interviews. Data collection occurred between April and December 2021. Survey data was analyzed descriptively, and the interviews underwent a framework analysis.Results and conclusionIn total, 191 respondents filled in the survey, of whom fourteen participated in the follow-up interviews. Out of the targeted 28 countries (EU and UK), 25 were represented in the survey. The majority of stakeholders were based in Western Europe. This study empirically elucidated numerous key legal and ethical issues related to GDPR compliance in the context of (cross-border) clinical research. It showed that the lack of legal harmonization remains the biggest challenge in the field, and that it is present not only at the level of the interplay of key EU legislative acts and national implementation of the GDPR, but also when it comes to interpretation at local, regional and institutional levels. Moreover, the role of ECs in data protection was further explored and possible ways forward for its normative delineation were discussed. According to the participants, the pandemic did not bring additional legal challenges. Although practical challenges (for instance, mainly related to the provision of information to patients) were high due to the globally enacted crisis measures, the key problematic issues on (cross-border) health research, interpretations of the legal texts and compliance strategies remained largely the same.

Several factors thwart successful data sharing—ambiguous or fragmented regulatory landscapes, conflicting institutional/researcher interests and varying levels of data science-related expertise are among these. Traditional ethics oversight mechanisms and practices may not be well placed to guarantee adequate research oversight given the unique challenges presented by digital technologies and artificial intelligence (AI). Data-intensive research has raised new, contextual ethics and legal challenges that are particularly relevant in an African research setting. Yet, no empirical research has been conducted to explore these challenges.We explored REC members’ views and experiences on data sharing by conducting 20 semi-structured interviews online between June 2022 and February 2023. Using purposive sampling and snowballing, we recruited representatives across sub-Saharan Africa (SSA). We transcribed verbatim and thematically analysed the data with Atlas.ti V22.Three dominant themes were identified: (i) experiences in reviewing data sharing protocols, (ii) perceptions of data transfer tools and (iii) ethical, legal and social challenges of data sharing. Several sub-themes emerged as: (i.a) frequency of and approaches used in reviewing data sharing protocols, (i.b) practical/technical challenges, (i.c) training, (ii.a) ideal structure of data transfer tools, (ii.b) key elements of data transfer tools, (ii.c) implementation level, (ii.d) key stakeholders in developing and reviewing a data transfer agreement (DTA), (iii.a) confidentiality and anonymity, (iii.b) consent, (iii.c) regulatory frameworks, and (iii.d) stigmatisation and discrimination.Our results indicated variability in REC members’ perceptions, suboptimal awareness of the existence of data protection laws and a unanimously expressed need for REC member training. To promote efficient data sharing within and across SSA, guidelines that incorporate ethical, legal and social elements need to be developed in consultation with relevant stakeholders and field experts, along with the training accreditation of REC members in the review of data-intensive protocols.

The aim of this survey was to chart how the universities in Finland have organised the depositing of digital research data and to what extent the data are reused by the scientific community after the original research has been completed. The respondents were professors of human sciences, social sciences and behavioural sciences in Finnish universities, and representatives of some research institutes. Opinions were also queried on the OECD guidelines and principles on open access to research data from public funding. First, the respondents were asked whether there were any guidelines or regulations concerning the depositing of digital research data in their departments, what happened to research data after the completion of the original research, and to what extent the data were reused. Further questions covered how often the data from completed research projects were reused in secondary research projects or for theses. The respondents also estimated what proportion of the data collected in their departments/institutes were reusable at the time of the survey, and why research data were not being reused in their own field of research. Views were also investigated on whether confidentiality or research ethics issues, or problems related to copyright or information technology formed barriers to data reuse. Opinions on the OECD Open Access guidelines on research data were queried. The respondents were asked whether they had earlier knowledge of the guidelines, and to what extent its principles could be implemented in their own disciplines. Some questions pertained to the advantages and disadvantages of open access to research data. The advantages mentioned included reducing duplicate data collection and more effective use of data resources, whereas the disadvantages mentioned included, for example, risks connected to data protection and misuse of data. The respondents also suggested ways of implementing the Open Access guidelines and gave their opinions on how binding the recommendations should be, to what extent various bodies should be involved in formulating the guidelines, and how the archiving and dissemination of digital research data should be organised. Blockchain has empowered computer systems to be more secure using a distributed network. However, the current blockchain design suffers from fairness issues in transaction ordering. Miners are able to reorder transactions to generate profits, the so-called miner extractable value (MEV). Existing research recognizes MEV as a severe security issue and proposes potential solutions, including prominent Flashbots. However, previous studies have mostly analyzed blockchain data, which might not capture the impacts of MEV in a much broader AI society. Thus, in this research, we applied natural language processing (NLP) methods to comprehensively analyze topics in tweets on MEV. We collected more than 20000 tweets with #MEV and #Flashbots hashtags and analyzed their topics. Our results show that the tweets discussed profound topics of ethical concern, including security, equity, emotional sentiments, and the desire for solutions to MEV. We also identify the co-movements of MEV activities on blockchain and social media platforms. Our study contributes to the literature at the interface of blockchain security, MEV solutions, and AI ethics.

CDEI plans to run a Fairness Innovation Challenge to support the development of novel solutions to address bias and discrimination across the artificial intelligence (AI) lifecycle. The challenge also aims to provide greater clarity about which assurance tools and techniques can be applied to address and improve fairness in AI systems, and encourage the development of holistic approaches to bias detection and mitigation, that move beyond purely technical notions of fairness.
As we finalise the design and scope of this challenge, the CDEI is now collecting use case submissions of specific fairness-related problems faced by organisations designing, developing, and/or deploying AI systems. This privacy notice explains who the CDEI are, the personal data the CDEI collects, how the CDEI uses it, who the CDEI shares it with, and what your legal rights are.
This story is about helping researchers create reusable data when their research has ethical constraints. Researchers are guided through appropriate paths to securing informed consent from research participants. This involves two aspects. The first is to make sure consent does not unnecessarily prevent preservation, sharing and reuse. The second is to ensure that adequate protections are applied to the creation or subsequent access to data through anonymisation or pseudonymisation techniques. It may also involve access restrictions being applied to data. This work effectively began in 2015 with the establishment of a research data support service at the University of Glasgow, but there is no ���finish��� date. Work is ongoing to continually refine, revise, and reform the support being offered.
