    Description

    The Low-Income Housing Tax Credit (LIHTC) is the most important resource for creating affordable housing in the United States today. The LIHTC database, created by HUD and available to the public since 1997, contains information on 48,672 projects and 3.23 million housing units placed in service since 1987. Low-Income Housing Tax Credit Qualified Census Tracts must have 50 percent of households with incomes below 60 percent of the Area Median Gross Income (AMGI) or have a poverty rate of 25 percent or more. Difficult Development Areas (DDA) are areas with high land, construction and utility costs relative to the area median income and are based on Fair Market Rents, income limits, the 2010 census counts, and 5-year American Community Survey (ACS) data.

    Description

    Income limits used to determine the income eligibility of applicants for assistance under three programs authorized by the National Housing Act. These programs are the Section 221(d)(3) Below Market Interest Rate (BMIR) rental program, the Section 235 program, and the Section 236 program. These income limits are listed by dollar amount and family size, and they are effective on the date issued. Due to the Housing and Economic Recovery Act of 2008 (Public Law 110-289), Income Limits used to determine qualification levels as well as set maximum rental rates for projects funded with tax credits authorized under section 42 of the Internal Revenue Code (the Code) and projects financed with tax exempt housing bonds issued to provide qualified residential rental development under section 142 of the Code (hereafter referred to as Multifamily Tax Subsidy Projects (MTSPs)) are now calculated and presented separately from the Section 8 income limits.

    A Qualified Census Tract (QCT) is any census tract (or equivalent geographic area defined by the Census Bureau) in which at least 50% of households have an income less than 60% of the Area Median Gross Income (AMGI). HUD has defined 60% of AMGI as 120% of HUD's Very Low Income Limits (VLILs), which are based on 50% of area median family income, adjusted for high cost and low income areas.

    The Low Income Housing Tax Credit (LIHTC) is a tax incentive intended to increase the availability of low income housing. Section 42 provides an income tax credit to owners of newly constructed or substantially rehabilitated low-income rental housing projects. The dollar amount of the LIHTC available for allocation by each state (the "credit ceiling") is limited by population. Each state is allocated credit based on $1.25 per resident. States may carry forward unused or returned credit derived from the credit ceiling for one year; if not used by then, credit goes into a national pool to be allocated to states as additional credit. State and local housing agencies allocate the state's credit ceiling among low-income housing buildings whose owners have applied for the credit. The LIHTC reduces income tax liability. It is taken annually for a term of ten years and is intended to yield a present value of either (1) 70 percent of the "qualified basis" for new construction or rehabilitation that are not federally subsidized (i.e., financed with tax-exempt bonds or below-market federal loans), or (2) 30 percent of the qualified basis for the cost of acquiring certain existing projects or projects that are federally subsidized. The actual credit rates are adjusted monthly for projects placed in service after 1987. The qualified basis represents the product of the "applicable fraction" of the building and the "eligible basis" of the building. The applicable fraction is based on the number of low income units in the building as a percentage of the total number of units, or based on the floor space of low income units as a percentage of the total floor space of residential units in the building. The eligible basis is the adjusted basis attributable to acquisition, rehabilitation, or new construction costs (depending on the type of LIHTC involved). In the case of buildings located in designated Qualified Census Tracts or designated Difficult Development Areas (DDA), eligible basis can be increased up to 130 percent of what it would otherwise be. This means that the available credit also can be increased by up to 30 percent. For example, if the 70 percent credit is available, it effectively could be increased up to 91 percent. There is a limit on the number of Qualified Census Tracts in any Metropolitan Statistical Area (MSA) or Primary Metropolitan Statistical Area (PMSA) that may be designated to receive an increase in eligible basis: all of the designated census tracts within a given MSA/PMSA may not together contain more than 20 percent of the total population of the MSA/PMSA.     Thumbnail image by Tony Moody.This dataset includes all housing developments approved by the City of Boise’s (“city”) Planning Division since 2020 that are known by the city to have received or are expected to receive support or incentives from a government entity. Each row represents one development. Data may be unavailable for some projects and details are subject to change until construction is complete. Addresses are excluded for projects with fewer than five homes for privacy reasons.

    The dataset includes details on the number of “homes” in a development. We use the word "home" to refer to any single unit of housing regardless of size, type, or whether it is rented or owned. For example, a building with 40 apartments counts as 40 homes, and a single detached house counts as one home.

    The dataset includes details about the phase of each project. The process for build a new development is as follows: First, one must receive approval from the city’s Planning Division, which is also known as being “entitled.” Next, one must apply for and receive a permit from the city’s Building Division before beginning construction. Finally, once construction is complete and all city inspections have been passed, the building can be occupied.

    The dataset also includes data on the affordability level of each development. To receive a government incentive, a developer is typically required to rent or sell a specified number of homes to households that have an income below limits set by the government and their housing cost must not exceed 30% of their income. The federal government determines income limits based on a standard called “area median income.” The city considers housing affordable if is targeted to households earning at or below 80% of the area median income. For a three-person household in Boise, that equates to an annual income of $60,650 and monthly rent or mortgage of $1,516.     Description

    The US Department of Housing and Urban Development (HUD) designates Qualified Census Tracts (QCTs) for purposes of the Low-Income Housing Tax Credit (LIHTC) program. The LIHTC program is defined in Section 42 of the Internal Revenue Code of 1986. The LIHTC is a tax incentive intended to increase the availability of affordable rental housing. The LIHTC statute provides two criteria for QCT eligibility. A census tract must have either: 1) a poverty rate of at least 25 percent; or 2) 50 percent or more of its householders must have incomes below 60 percent of the area median household income. The area corresponds to a metropolitan or a non-metropolitan area. Further, the LIHTC statute requires that no more than 20 percent of the metropolitan area population reside within designated QCTs (This limit also applies collectively to the nonmetropolitan counties in each state). Thus, it is possible for a tract to meet one or both of the above criteria, but not be designated as a QCT. With respect to the census tracts, the Census Bureau defines them in cooperation with local authorities every ten years for the purposes of the decennial census and, following a public comment period, has recently completed defining tract boundaries for the 2010 Census. Note that when census tract boundaries are set, they remain unchanged for the next decade. Thus, tract boundaries will not be changed until the 2020 Decennial Census.

    This dataset provides access to Qualified Census Tracts (QCTs) in Connecticut to assist in administration of American Rescue Plan (ARP) funds.

    The Secretary of HUD must designate QCTs, which are areas where either 50 percent or more of the households have an income less than 60 percent of the AMGI for such year or have a poverty rate of at least 25 percent.

    HUD designates QCTs based on new income and poverty data released in the American Community Survey (ACS). Specifically, HUD relies on the most recent three sets of ACS data to ensure that anomalous estimates, due to sampling, do not affect the QCT status of tracts.

    QCTs are identified for the purpose of Low-Income Housing Credits under IRC Section 42, with the purpose of increasing the availability of low-income rental housing by providing an income tax credit to certain owners of newly constructed or substantially rehabilitated low-income rental housing projects.

    Also included are the number of households from the 2010 census (the “p0150001” variable), the average poverty rate using the 2014-2018 ACS data (the “pov_rate_18” variable), and the ratio of Tract Average Household Size Adjusted Income Limit to Tract Median Household Income using the 2014-2018 ACS data (the “inc_factor_18” variable). For the last variable mentioned in the previous paragraph, the income limit is the limit for being considered a very low income household (size-adjusted and based on Area Mean Gross Income). This value is divided by the median household income for the given tract, to get a sense of how the limit and median incomes compare. For example, if ratio>1, it implies that the tract is very low income because the limit income is greater than the median income. This ratio is a compact way to include the separate variables for the household income limit and median household income for each tract.

    Description

    A Home for Everyone is the City of Boise’s (city) initiative to address needs in the community by supporting the development and preservation of housing affordable to residents on Boise budgets. A Home for Everyone has three core goals: produce new homes affordable at 60% of area median income, create permanent supportive housing for households experiencing homelessness, and preserve home affordable at 80% of area median income. This dataset includes information about all homes that count toward the city’s Home for Everyone goals.

    While the “produce affordable housing” and “create permanent supportive housing” goals are focused on supporting the development of new housing, the preservation goal is focused on maintaining existing housing affordable. As a result, many of the data fields related to new development are not relevant to preservation projects. For example, zoning incentives are only applicable to new construction projects.

    Data may be unavailable for some projects and details are subject to change until construction is complete. Addresses are excluded for projects with fewer than five homes for privacy reasons.

    The dataset includes details on the number of “homes”. We use the word "home" to refer to any single unit of housing regardless of size, type, or whether it is rented or owned. For example, a building with 40 apartments counts as 40 homes, and a single detached house counts as one home.

    The dataset includes details about the phase of each project when a project involves constructing new housing. The process for building a new development is as follows: First, one must receive approval from the city’s Planning Division, which is also known as being “entitled.” Next, one must apply for and receive a permit from the city’s Building Division before beginning construction. Finally, once construction is complete and all city inspections have been passed, the building can be occupied.

    To contribute to a city goal, homes must meet affordability requirements based on a standard called area median income. The city considers housing affordable if is targeted to households earning at or below 80% of the area median income. For a three-person household in Boise, that equates to an annual income of $60,650 and monthly housing cost of $1,516. Deeply affordable housing sets the income limit at 60% of area median income, or even 30% of area median income. See Boise Income Guidelines for more details.Project Name – The name of each project. If a row is related to the Home Improvement Loan program, that row aggregates data for all homes that received a loan in that quarter or year. Primary Address – The primary address for the development. Some developments encompass multiple addresses.Project Address(es) – Includes all addresses that are included as part of the development project.Parcel Number(s) – The identification code for all parcels of land included in the development.Acreage – The number of acres for the parcel(s) included in the project.Planning Permit Number – The identification code for all permits the development has received from the Planning Division for the City of Boise. The number and types of permits required vary based on the location and type of development.Date Entitled – The date a development was approved by the City’s Planning Division.Building Permit Number – The identification code for all permits the development has received from the city’s Building Division.Date Building Permit Issued – Building permits are required to begin construction on a development.Date Final Certificate of Occupancy Issued – A certificate of occupancy is the final approval by the city for a development, once construction is complete. Not all developments require a certificate of occupancy.Studio – The number of homes in the development that are classified as a studio. A studio is typically defined as a home in which there is no separate bedroom. A single room serves as both a bedroom and a living room.1-Bedroom – The number of homes in a development that have exactly one bedroom.2-Bedroom – The number of homes in a development that have exactly two bedrooms.3-Bedroom – The number of homes in a development that have exactly three bedrooms.4+ Bedroom – The number of homes in a development that have four or more bedrooms.# of Total Project Units – The total number of homes in the development.# of units toward goals – The number of homes in a development that contribute to either the city’s goal to produce housing affordable at or under 60% of area median income, or the city’s goal to create permanent supportive housing for households experiencing homelessness. Rent at or under 60% AMI - The number of homes in a development that are required to be rented at or below 60% of area median income.     The US Department of Housing and Urban Development (HUD) designates Qualified Census Tracts (QCTs) for purposes of the Low-Income Housing Tax Credit (LIHTC) program. The LIHTC program is defined in Section 42 of the Internal Revenue Code of 1986. The LIHTC is a tax incentive intended to increase the availability of affordable rental housing. The LIHTC statute provides two criteria for QCT eligibility. A census tract must have either: 1) a poverty rate of at least 25 percent; or 2) 50 percent or more of its householders must have incomes below 60 percent of the area median household income. The area corresponds to a metropolitan or a non-metropolitan area. Further, the LIHTC statute requires that no more than 20 percent of the metropolitan area population reside within designated QCTs (This limit also applies collectively to the nonmetropolitan counties in each state). Thus, it is possible for a tract to meet one or both of the above criteria, but not be designated as a QCT. With respect to the census tracts, the Census Bureau defines them in cooperation with local authorities every ten years for the purposes of the decennial census and, following a public comment period, has recently completed defining tract boundaries for the 2010 Census. Note that when census tract boundaries are set, they remain unchanged for the next decade. Thus, tract boundaries will not be changed until the 2020 Decennial Census.This is a MD iMAP hosted service.     Maximum payment and allowable private income amounts for the period from July 1, 2025 to June 30, 2026 are:

    • $90 monthly for single seniors (maximum monthly payment amount), your annual private income must be less than $4,320
    • $180 monthly for senior couples (maximum monthly payment amount), your annual private income must be less than $8,640

    The data is organized by private income levels. GAINS payments are provided on top of the Old Age Security (OAS) pension and the Guaranteed Income Supplement (GIS) payments you may receive from the federal government.

    Boston's ordinance on short-term rentals is designed to incorporate the growth of the home-share industry into the City's work to create affordable housing for all residents. We want to preserve housing for residents while allowing Bostonians to benefit from this new industry. Starting on on January 1, 2019, short-term rentals in Boston will need to register with the City of Boston.

    Eligibility for every unit in the City of Boston is dependant on the following six criteria:

    • No affordability covenant restrictions
    • Compliance with housing laws and codes
    • No violations of laws regarding short-term rental use
    • Owner occupied
    • Two- or three-family dwelling
    • Residential use classification

    The Short-Term Rental Eligibility Dataset leverages information, wherever possible, about these criteria. For additional details and information about these criteria, please visit https://www.boston.gov/short-term-rentals.


    ABOUT THIS DATASET

    In June 2018, a citywide ordinance established new guidelines and regulations for short-term rentals in Boston. Registration opened January 1, 2019. The Short-Term Rental Eligibility Dataset was created to help residents, landlords, and City officials determine whether a property is eligible to be registered as a short-term rental.

    The Short-Term Rental Eligibility Dataset currently joins data from the following datasets and is refreshed nightly:


    HOW TO DETERMINE ELIGIBILITY FOR SHORT-TERM RENTAL REGISTRATION

    1. ** Open** the Short-Term Rental Eligibility Dataset. In the dataset's search bar, enter the address of the property you are seeking to register.

    2. Find the row containing the correct address and unit of the property you are seeking. This is the information we have for your unit.

    3. Look at the columns marked as “Home-Share Eligible,” “Limited-Share Eligible,” and “Owner-Adjacent Eligible.”

    4. If your unit has a “yes” under “Home-Share Eligible,” “Limited-Share Eligible,” or “Owner-Adjacent Eligible,” you can register your unit here.


    WHY IS MY UNIT LISTED AS “NOT ELIGIBLE”?

    If you find that your unit is listed as NOT eligible, and you would like to understand more about why, you can use the Short-Term Rental Eligibility Dataset to learn more. The following columns measure each of the six eligibility criteria in the following ways:

    1. No affordability covenant restrictions

      • A “yes” in the “Income Restricted” column tells you that the unit is marked as income restricted and is NOT eligible.

      • The “Income Restricted” column measures whether the unit is subject to an affordability covenant, as reported by the Department of Neighborhood Development and/or the Boston Planning and Development Agency.

      • For questions about affordability covenants, contact the Department of Neighborhood Development.

    2. Compliance with housing laws and codes

      • A “yes” in the “Problem Properties” column tells you that this unit is considered a “Problem Property” by the Problem Properties Task Force and is NOT eligible.

      • A “yes” in the “Problem Property Owner” column tells you that the owner of this unit also owns a “Problem Property,” as reported by the Problem Properties Task Force.

      • Owners with any properties designated as a Problem Property are NOT eligible.

      • No unit owned by the owner of a “Problem Property” may register a short-term rental.

      • Learn more about how “Problem Properties” are defined here.

      • The “Open Violation Count” column tells you how many open violations the unit has. Units with any open violations are NOT eligible. Violations counted include: violations of the sanitary, building, zoning, and fire code; stop work orders; and abatement orders.

      • NOTE: Violations written before 1/1/19 that are still open will make a unit NOT eligible until these violations are resolved.

      • If your unit has an open violation, visit these links to appeal your violation(s) or pay your code violation fine(s).

      • The “Violations in the Last 6 Months” column tells you how many violations the unit has received in the last six months. Units with three or more violations, whether open or closed, are NOT eligible.

      • NOTE: Only violations written on or after 1/1/19 will count against this criteria.

    3. No violations of laws regarding short-term rental use

      • A “yes” in the “Legally Restricted” column tells you that there is a complaint against the unit that finds

        • A legal restriction that prohibits the use of the unit as a Short-Term Rental under local, state, or federal law, OR

        • legal restriction that prohibits the use of the unit as a Short-Term Rental under condominium bylaws.

        • Units with legal restrictions found upon investigation are NOT eligible.

        • If the investigation of a complaint against the unit yields restrictions of the nature detailed above, we will mark the unit with a “yes” in this column. Until such complaint-based investigations begin, all units are marked with “no.”

        • NOTE: Currently no units have a “legally restricted” designation.

    4. Owner-occupied

      • A “no” in the “Unit Owner-Occupied” column tells you that there is NO Residential Tax Exemption filed for that unit via the Assessing Department, and that unit is automatically categorized as NOT eligible for the following Short-Term Rental types:

        • Home-Share
        • Limited-Share

        • Residential Tax Exemption indicates that a unit is owner-occupied and generates a “yes” in the “Unit Owner-Occupied” column.

        • Owners are not required to file a Residential Tax Exemption in order to be eligible to register a unit as a Short-Term Rental.

        • If you would like to apply for Residential Tax Exemption, you can apply here.

        • If you are the owner-occupant of a unit and you have not filed for Residential Tax Exemption, you can still register your unit by proving owner-occupancy.

The Low-Income Housing Tax Credit (LIHTC) is the most important resource for creating affordable housing in the United States today. The LIHTC database, created by HUD and available to the public since 1997, contains information on 48,672 projects and 3.23 million housing units placed in service since 1987. Low-Income Housing Tax Credit Qualified Census Tracts must have 50 percent of households with incomes below 60 percent of the Area Median Gross Income (AMGI) or have a poverty rate of 25 percent or more. Difficult Development Areas (DDA) are areas with high land, construction and utility costs relative to the area median income and are based on Fair Market Rents, income limits, the 2010 census counts, and 5-year American Community Survey (ACS) data.
