Also for the 2021 rent index survey, according to the legal requirements, only rents that have been newly agreed or adjusted in the last four years and are not subject to any price maintenance were taken into account. The preparation takes place under the auspices of the authority for urban development and housing and is accompanied by a working group, which includes representatives of the tenant and landlord organizations as well as the courts. The rental values depend not only on aspects such as the size of the apartment or the equipment, but also on the classification of the respective residential area. For this purpose, the online rental index draws on the data from the non-official Hamburg residential register 2021, which was compiled on the basis of a representative data collection by Analyse & Konzept Beratungsgesellschaft für Wohnen, Immobilien, Stadtentwicklung mbH. The rent index data can only be used correctly if the "explanations on the rent index" and the notes on the "application of the rent index" are carefully observed.

This indicator presents information on key aspects of regulation in the private rental sector, mainly collected through the OECD Questionnaire on Affordable and Social Housing (QuASH). It presents information on rent control, tenant-landlord relations, lease type and duration, regulations regarding the quality of rental dwellings, and measures regulating short-term holiday rentals. It also presents public supports in the private rental market that were introduced in response to the COVID-19 pandemic. Information on rent control considers the following dimensions: the control of initial rent levels, whether the initial rents are freely negotiated between the landlord and tenants or there are specific rules determining the amount of rent landlords are allowed to ask; and regular rent increases – that is, whether rent levels regularly increase through some mechanism established by law, e.g. adjustments in line with the consumer price index (CPI).
