    Description

    Class EL3 easements are tow and footage easements for the riparian properties of a watercourse or a federal lake, pursuant to articles L.2131-2 to L.2131-6 of the General Code of Property for Public Persons (CGPPP): * Walking easements The riparian properties of a watercourse or a federal lake are encumbered on each bank by a 3.25-metre easement, known as a walkway easement. This easement prohibits riparian landowners from planting trees or closing by hedges or otherwise. * Towing easements Easement in respect of federal watercourses where there is a tow or operating road of interest to the navigation service. The easement strikes the properties in a space of 7.80 meters wide along the edges of these federal watercourses, as well as on the islands where it is needed. Riparian owners may not plant trees or close by hedges or otherwise only at a distance of 9.75 metres on the edges where there is a towing or operating path. * Servitude for the use of fishermen On the encumbered lands there are walk and tow easements, a so-called “fisherman’s use” easement. Article L2131-2 of the General Code of Property for Public Persons (CGPPP) provides that “Every owner, tenant, farmer or holder of a right in rem, riparian of a watercourse or a federal lake is obliged to leave the land encumbered by that easement for the use of the watercourse or lake manager, fishers and pedestrians.” In addition, “Along navigation channels, fishermen and pedestrians may use the towway and the portion of the bank in the public domain, to the extent permitted by the operation of navigation.” By decision of the administrative authority, the right referred to in the preceding subparagraph may exceptionally be abolished either for reasons of general interest or for safety reasons where the banks are included in industrial establishments. This resource describes the surface plates of the EL3 easements, i.e. buffer zones around generators. The DDT of the Tarn is concerned by the easement of foot.

    Description

    Category PT3 easements concern easements on private property established for the benefit of operators of telecommunications networks (electronic communication) open to the public in order to allow the installation and operation of network equipment, including fixed and mobile very high-speed network equipment: - on and in parts of multi-family buildings and subdivisions for common use, including those capable of accommodating radio installations or equipment; - on the ground and in the basement of unbuilt properties, including those capable of accommodating radio installations or equipment; - above private property in so far as the operator merely uses the installation of a third party benefiting from easements without compromising, where appropriate, the specific public service mission entrusted to that third party.

    The installation of the structures of the telecommunications network (electronic communication) may not prevent the right of the owners or co-owners to demolish, repair, modify or close their property. However, the owners or co-owners must, at least three months before undertaking work likely to affect the works, notify the beneficiary of the easement. Agents of authorized operators must be provided with a certificate signed by the beneficiary of the easement and the company to which the agent belongs to access the immovable, subdivision or unbuilt property. When, for the study, the realization and the operation of the installations, the introduction of these agents in the private properties is necessary, it is, in the absence of an amicable agreement, authorized by the president of the tribunal de grande instance, ruling as in matters of interim relief, which ensures that the presence of the agents is necessary. The beneficiary of the easement is responsible for all damages that originate in the equipment of the network. It is required to compensate all direct and certain damage caused both by the installation and maintenance work and by the existence or operation of the works. In the absence of an amicable agreement, the compensation is fixed by the court of expropriation seized by the most diligent party.

    This resource describes the linear bases of PT1 easements combined with their generators, i.e. the buried structures of the telecommunications network.

    The Florida TIITF Land Records Spatial Index is a document based GIS layer to be displayed as a map comprised of polygons and attributes representing parcels described in deeds, leases, easements and other instruments archived in the Title Archives of the Division of State Lands, Department of Environmental Protection for the Florida Board of Trustees of the Internal Improvement Trust Fund (TIITF). The polygons represent parcels described in the archived TIITF land record documents; this is not a tax map or a representation of current ownership. The data includes acquisitions, dispositions and encumbrances. Selecting a parcel on the map may return information about several different documents associated with that parcel through out the history of State land transactions involving that parcel.

    The Geospatial Data Gateway (GDG) provides access to a map library of over 100 high resolution vector and raster layers in the Geospatial Data Warehouse. It is the one stop source for environmental and natural resource data, available anytime, from anywhere. It allows a user to choose an area of interest, browse and select data, customize the format, then download or have it shipped on media. The map layers include data on: Public Land Survey System (PLSS), Census data, demographic statistics, precipitation, temperature, disaster events, conservation easements, elevation, geographic names, geology, government units, hydrography, hydrologic units, land use and land cover, map indexes, ortho imagery, soils, topographic images, and streets and roads.     Description

    The CDFW Owned and Operated Lands and Conservation Easements dataset is a subset of the CDFW Lands dataset. It contains lands owned (fee title), some operated (wildlife areas, ecological reserves, and public/fishing access properties that are leases/agreements with other agencies that may be publicly accessible) and conservation easements held by CDFW. CDFW Owned and Operated Lands and Conservation Easements replaces the prior dataset, DFG Owned and Operated Lands, which included only fee title lands and some operated lands (wildlife areas, ecological reserves, and public/fishing access properties that are leases/agreements with other agencies and that may be publicly accessible). This is a generalized version dataset that has a shorter attribute table than the original and also has been dissolved based on the fields included. Please note that some lands may not be accessible due to the protection of resources and habitat. It is recommended that users contact the appropriate regional office for access information and consult regulations for CDFW lands in Sections 550, 550.1, 551, 552, 630 and 702. For information on public use regulations on Department lands, please refer to the Public Uses on State and Federal Lands section of the Waterfowl, Upland Game, and Public Use Regulations booklet for both statewide and property-specific regulations https://wildlife.ca.gov/Regulations. All visitors are responsible for knowing and following the general and property-specific regulations.

    The CDFW Lands dataset is a digitized geographical inventory of selected lands owned and/or administered by the California Department of Fish and Wildlife. Properties such as ecological reserves, wildlife areas, undesignated lands containing biological resource values, public and fishing access lands, and CDFW fish hatcheries are among those lands included in this inventory. Types of properties owned or administered by CDFW which may not be included in this dataset are parcels less than 1 acre in size, such as fishing piers, fish spawning grounds, fish barriers, and other minor parcels. Physical boundaries of individual parcels are determined by the descriptions contained in legal documents and assessor parcel maps relating to that parcel. The approximate parcel boundaries are drawn onto U.S. Geological Survey 7.5'-series topographic maps, then digitized and attributed before being added to the dataset. In some cases, assessor parcel or best available datasets are used to digitize the boundary. Using parcel data to adjust the boundaries is a work in progress and will be incorporated in the future. Township, range, and section lines were based on the U.S. Geological Survey 7.5' series topographic maps (1:24,000 - scale). In some areas, the boundaries will not align with the Bureau of Land Management's Public Lands Survey System (PLSS). See the "SOURCE" field for data used to digitize boundary.

    Description

    The USGS Protected Areas Database of the United States (PAD-US) is the nation's inventory of protected areas, including public open space and voluntarily provided, private protected areas, identified as an A-16 National Geospatial Data Asset in the Cadastral Theme (http://www.fgdc.gov/ngda-reports/NGDA_Datasets.html). PAD-US is an ongoing project with several published versions of a spatial database of areas dedicated to the preservation of biological diversity, and other natural, recreational or cultural uses, managed for these purposes through legal or other effective means. The geodatabase maps and describes public open space and other protected areas. Most areas are public lands owned in fee; however, long-term easements, leases, and agreements or administrative designations documented in agency management plans may be included. The PAD-US database strives to be a complete “best available” inventory of protected areas (lands and waters) including data provided by managing agencies and organizations. The dataset is built in collaboration with several partners and data providers (http://gapanalysis.usgs.gov/padus/stewards/). See Supplemental Information Section of this metadata record for more information on partnerships and links to major partner organizations. As this dataset is a compilation of many data sets; data completeness, accuracy, and scale may vary. Federal and state data are generally complete, while local government and private protected area coverage is about 50% complete, and depends on data management capacity in the state. For completeness estimates by state: http://www.protectedlands.net/partners. As the federal and state data are reasonably complete; focus is shifting to completing the inventory of local gov and voluntarily provided, private protected areas. The PAD-US geodatabase contains over twenty-five attributes and four feature classes to support data management, queries, web mapping services and analyses: Marine Protected Areas (MPA), Fee, Easements and Combined. The data contained in the MPA Feature class are provided directly by the National Oceanic and Atmospheric Administration (NOAA) Marine Protected Areas Center (MPA, http://marineprotectedareas.noaa.gov ) tracking the National Marine Protected Areas System. The Easements feature class contains data provided directly from the National Conservation Easement Database (NCED, http://conservationeasement.us ) The MPA and Easement feature classes contain some attributes unique to the sole source databases tracking them (e.g. Easement Holder Name from NCED, Protection Level from NOAA MPA Inventory). The "Combined" feature class integrates all fee, easement and MPA features as the best available national inventory of protected areas in the standard PAD-US framework. In addition to geographic boundaries, PAD-US describes the protection mechanism category (e.g. fee, easement, designation, other), owner and managing agency, designation type, unit name, area, public access and state name in a suite of standardized fields. An informative set of references (i.e. Aggregator Source, GIS Source, GIS Source Date) and "local" or source data fields provide a transparent link between standardized PAD-US fields and information from authoritative data sources. The areas in PAD-US are also assigned conservation measures that assess management intent to permanently protect biological diversity: the nationally relevant "GAP Status Code" and global "IUCN Category" standard. A wealth of attributes facilitates a wide variety of data analyses and creates a context for data to be used at local, regional, state, national and international scales.     Description

    Public utility easements (SUPs) are administrative limitations on the right to property, they are established for the benefit of public persons, concessionaires of public works or public works, private persons engaged in an activity in the public interest. The collection and conservation of public utility easements is a sovereign task of the State, which must bring them to the attention of local and regional authorities so that they may annex them to their urban planning documents. The public utility easements concerned are those defined by Articles L. 126-1 and R. 126-1 of the Urban Planning Code and their annexes.

    PM1 type SUPs result from the establishment of the Predictable Natural Risk Prevention Plans (PPRNP) and Mining Risk Prevention Plans (PPRMs) drawn up pursuant to Articles L. 562-1 et seq. of the Environmental Code.

    The reference date of the data is the date of approval of the last RPP (PRP of the Riomoise agglomeration)

    From nrcs.usda.gov/programs-initiatives-easements: NRCS offers easement programs to landowners who want to maintain or enhance their land in a way beneficial to agriculture and/or the environment. All NRCS easement programs are voluntary. We provide technical help and financial assistance, but local landowners and organizations are needed to make NRCS easement programs successful.The Agricultural Conservation Easement Program (ACEP) provides financial and technical assistance to help conserve agricultural lands and wetlands and their related benefits. Under the Agricultural Land Easements component, NRCS helps Indian tribes, state and local governments and non-governmental organizations protect working agricultural lands and limit non-agricultural uses of the land. Under the Wetlands Reserve Easements component, NRCS helps to restore, protect and enhance enrolled wetlands. The Healthy Forests Reserve Program (HFRP) helps landowners restore, enhance and protect forestland resources on private lands through easements and financial assistance. Through HRFP, landowners promote the recovery of endangered or threatened species, improve plant and animal biodiversity and enhance carbon sequestration.The Grasslands Reserve Program (GRP) protected, restored, and enhanced grassland, including rangeland, pastureland, shrubland, and certain other lands.The Farm and Ranch Land Protection Program (FRPP) helped purchase development rights which kept productive farm and ranchland in agricultural uses.The Wetlands Reserve Program (WRP) protected, restored and enhanced wetlands. It had the goal of achieving the greatest wetland functions and optimum wildlife habitat on every acre enrolled in it.

    River Reach Habitat Quality (RFC 2008)

    This layer was digitized in 2015 for the HRS Board using data from the 2008 State of the Watershed Report. This layer shows the quality of habitat surveyed by Delia Malone on selected reaches in the Roaring Fork Watershed. This data is intended as a reference for future research and planning, site specific conditions may vary. Strahler Steam Order numbers are also given for each river reach.

    River Watch Sites

    This layer was digitized in 2015 for the HRS Board using data from the Roaring Fork Conservancy. The layer shows River Watch sites where the RFC and partner organizations monitor stream health indicators. Active sites are marked with an “x” in the popup.     Category EL3 easements relate to towing and walking easements (inner navigation), i.e. * Walking easements: The riparian properties of a watercourse or a federal lake are encumbered on each bank by a 3,25 metre easement, known as a walkway easement. This easement prohibits riparian landowners from planting trees or closing by hedges or otherwise. * Towing easements: Easement in respect of federal watercourses where there is a tow or operating road of interest to the navigation service. The easement strikes the properties in a space of 7.80 meters wide along the edges of these federal watercourses, as well as on the islands where it is needed. Riparian owners may not plant trees or close by hedges or otherwise only at a distance of 9.75 metres on the edges where there is a towing or operating path. * Servitudes for the use of fishermen: On the encumbered lands there are walk and tow easements, a so-called “fisherman’s use” easement. Article L2131-2 of the CGPPP provides that “Any owner, tenant, farmer or holder of a right in rem, riparians of a watercourse or a federal lake shall be required to leave the land encumbered by that walkway for the use of the manager of that watercourse or lake, fishermen and pedestrians.” By decision of the administrative authority, the right referred to in the preceding subparagraph may exceptionally be abolished either for reasons of general interest or for safety reasons where the banks are included in industrial establishments.     Description

    The following may be classified as protective forests, for reasons of public utility: — woods and forests the conservation of which is recognised as necessary for the maintenance of land on mountains and slopes, protection against avalanches, erosions and flooding of waters and sands; — woods and forests located on the periphery of large agglomerations; — woods and forests located in areas where maintenance is necessary either for ecological reasons or for the well-being of the population. Protection forests shall be subject to a special forestry regime, in particular as regards management and operating rules, the exercise of grazing and user rights, excavations and extractions of materials and the research and exploitation of the water resource by public authorities or their delegates. Classification as a protective forest prohibits any change in land use or land use that would compromise the conservation or protection of afforestation.
