    This shape file characterizes the geographic representation of land parcels within the State of Alaska contained by the Easements category. It has been extracted from data sets used to produce the State status plats. This data set includes cases noted on the digital status plats up to one day prior to data extraction.

    Each feature has an associated attribute record, including a Land Administration System (LAS) file-type and file-number which serves as an index to related LAS case-file information.     Unofficial data, digitised from administrative documents collected by DDT 77, contact the manager or consult the GPU to obtain data that can be used in a regulatory framework. Easements on private property established for the benefit of operators of telecommunications networks (electronic communication) open to the public in order to allow the installation and operation of network equipment, including fixed and mobile very high-speed network equipment: — on and in parts of collective buildings and subdivisions for common use, including those capable of accommodating radio installations or equipment; — on the ground and in the basement of unbuilt properties, including those capable of accommodating radio installations or equipment; — above private property to the extent that the operator merely uses the installation of a third party benefiting from easements without compromising, where appropriate, the own public service task entrusted to that third party. The installation of the structures of the telecommunications network (electronic communication) cannot hinder the right of owners or co-owners to demolish, repair, modify or close their property. However, the owners or co-owners must, at least three months before undertaking work likely to affect the works, notify the beneficiary of the easement. Texts in force: — L. 45-9, L. 48 and R. 20-55 to R. 20-62 of the Postal and Electronic Communications Code The linear entities of this data relate to the use of certain resources and equipment, they affect land use. With the collection of easements from third parties, DDT-77 cannot guarantee the completeness and accuracy of the deferral of these easements on a large-scale map.

    This is a polygon data set that depicts the locations of easements and vacations of easements granted to the City of Boise. An easement is a legal right to make use of land owned by another party, for a specific and limited purpose as specified within an easement description. An easement vacation is a legal declaration to relinquish to the parcel owner the easement that was formerly granted. Easements are attained by the City of Boise in the following ways: 1)through right-of-way vacation from Ada County Highway District where the City of Boise retains rights to build and maintain utility structures across the area vacated within the vacation description; 2)a Boise City Council resolution where a grantor gives the City the right to build and maintain sanitary sewer, geothermal, drainage or pressure irrigation across their property; 3)as a grant of easement or grant deed recorded at Ada County; and 4) as a note on a subdivision final plat that a specific lot, portion of a lot or lots is shown to have an easement across it (them) and may or may not include dimensions of the easement. All easements in this data set are within the Boise City Area of Impact. This data set is maintained by Boise City Public Works GIS staff. Features in this data set are derived from available computer aided drafting CAD drawings, paper map documents and legal descriptions that define easement locations. Easements have been granted to the City of Boise since about 1900 to the present. Documentation of easements prior to 1970 is incomplete; therefore most of the easements in this data set will be from 1970 to the present. The data is updated continuously. It is current to the date it was published.

    Description

    This data is intended as a reference material of street and alley vacations, but not designed for survey, accurate positioning, or legal documents. It is created as polygon feature class, vacation information based on field measurements, types of Right of Way, and citations of Journal of the Common Council (J.C.C.) and the plat Liber and Page is listed under the column titled 'Sub_Plat'. The paper maps of the Street and Alley Vacation, the raster layer version of those maps (Linen Map Markup Mosaic), and the Detroit parcel layer are used as base maps to create this data.

    The street and alley vacations were recorded from 1831 to 2022 throughout the whole city, and it will be updated weekly. The existed and/or active street and alley vacations are ready to view, the authors are working on pending and historical records.

    Red Features - Have been "Outright" vacated, meaning the right of way has become private property with no restrictions.
    Blue Features - Have been vacated with reserve of a utility easement, meaning the right of way has become private property with access rights for utility companies.

    *Note: Special values within the 'Jurisdiction' field:

    Category PT3 easements concern easements on private property established for the benefit of operators of telecommunications networks (electronic communication) open to the public in order to allow the installation and operation of network equipment, including fixed and mobile very high-speed network equipment: - on and in parts of multi-family buildings and subdivisions for common use, including those capable of accommodating radio installations or equipment; - on the ground and in the basement of unbuilt properties, including those capable of accommodating radio installations or equipment; - above private property in so far as the operator merely uses the installation of a third party benefiting from easements without compromising, where appropriate, the specific public service mission entrusted to that third party.

    The installation of the structures of the telecommunications network (electronic communication) may not prevent the right of the owners or co-owners to demolish, repair, modify or close their property. However, the owners or co-owners must, at least three months before undertaking work likely to affect the works, notify the beneficiary of the easement. Agents of authorized operators must be provided with a certificate signed by the beneficiary of the easement and the company to which the agent belongs to access the immovable, subdivision or unbuilt property. When, for the study, the realization and the operation of the installations, the introduction of these agents in the private properties is necessary, it is, in the absence of an amicable agreement, authorized by the president of the tribunal de grande instance, ruling as in matters of interim relief, which ensures that the presence of the agents is necessary. The beneficiary of the easement is responsible for all damages that originate in the equipment of the network. It is required to compensate all direct and certain damage caused both by the installation and maintenance work and by the existence or operation of the works. In the absence of an amicable agreement, the compensation is fixed by the court of expropriation seized by the most diligent party.

    This resource describes the linear bases of PT1 easements combined with their generators, i.e. the buried structures of the telecommunications network.

    This data set was collected to create a comprehensive platform to visualize SWP owned land. The parcels were created from record parcel information displayed on Department CAD maps known as “Property Management Maps”. This CAD data was then converted to a compatible GIS source and imported as parcels. Each parcel displays the pertinent information regarding the Departments ownership rights and the time that it was acquired or granted. This data set was created to improve the efficiently of accessing and organize the departments land records.

    Class EL3 easements are tow and footage easements for the riparian properties of a watercourse or a federal lake, pursuant to articles L.2131-2 to L.2131-6 of the General Code of Property for Public Persons (CGPPP): * Walking easements The riparian properties of a watercourse or a federal lake are encumbered on each bank by a 3.25-metre easement, known as a walkway easement. This easement prohibits riparian landowners from planting trees or closing by hedges or otherwise. * Towing easements Easement in respect of federal watercourses where there is a tow or operating road of interest to the navigation service. The easement strikes the properties in a space of 7.80 meters wide along the edges of these federal watercourses, as well as on the islands where it is needed. Riparian owners may not plant trees or close by hedges or otherwise only at a distance of 9.75 metres on the edges where there is a towing or operating path. * Servitude for the use of fishermen On the encumbered lands there are walk and tow easements, a so-called “fisherman’s use” easement. Article L2131-2 of the General Code of Property for Public Persons (CGPPP) provides that “Every owner, tenant, farmer or holder of a right in rem, riparian of a watercourse or a federal lake is obliged to leave the land encumbered by that easement for the use of the watercourse or lake manager, fishers and pedestrians.” In addition, “Along navigation channels, fishermen and pedestrians may use the towway and the portion of the bank in the public domain, to the extent permitted by the operation of navigation.” By decision of the administrative authority, the right referred to in the preceding subparagraph may exceptionally be abolished either for reasons of general interest or for safety reasons where the banks are included in industrial establishments. This resource describes the surface plates of the EL3 easements, i.e. buffer zones around generators. The DDT of the Tarn is concerned by the easement of foot.

    Description

    This dataset contains land use authorization leases, permits and easement cases derived from Legal Land Descriptions (LLD) contained in the US Bureau of Land Management's, BLM, Mineral and Land Record System(MLRS) and geocoded (mapped) using the Public Land Survey System (PLSS) derived from the most accurate survey data available through BLM Cadastral Survey workforce. The minimum data entry requirement for legal description for linear authorizations is to the nearest 40 acre aliquot level (e.g.,NENW). Legal descriptions for non-linear authorizations are as described on the authorizing document. Geospatial representations might be missing for some cases that can not be geocoded using the MLRS algorithm. This data set contains cases with the dispositions of 'Authorized', 'Pending','Closed', and 'Interim'.Each case is given a data quality score based on how well it mapped. These can be lumped into seven groups to provide a simplified way to understand the scores. Group 1: Direct PLSS Match. Scores “0”, “1”, “2”, “3” should all have a match to the PLSS data. There are slight differences, but the primary expectation is that these match the PLSS. Group 2: Calculated PLSS Match. Scores “4”, “4.1”, “5”, “6”, “7” and “8” were generated through a process of creating the geometry that is not a direct capture from the PLSS. They represent a best guess based on the underlining PLSS Group 3 – Mapped to Section. Score of “8.1”, “8.2”, “8.3”, “9” and “10” are mapped to the Section for various reasons (refer to log information in data quality field). Group 4- Combination of mapped and unmapped areas. Score of 15 represents a case that has some portions that would map and others that do not. Group 5 – No NLSDB Geometry, Only Attributes. Scores “11”, “12”, “20”, “21” and “22” do not have a match to the PLSS and no geometry is in the NLSDB, and only attributes exist in the data. Group 6 – Mapped to County. Scores of “25” map to the County. Group 7 – Improved Geometry. Scores of “100” are cases that have had their geometry edited by BLM staff using ArcGIS Pro or MLRS bulk upload tool.

    Description

    The CDFW Owned and Operated Lands and Conservation Easements dataset is a subset of the CDFW Lands dataset. It contains lands owned (fee title), some operated (wildlife areas, ecological reserves, and public/fishing access properties that are leases/agreements with other agencies that may be publicly accessible) and conservation easements held by CDFW. CDFW Owned and Operated Lands and Conservation Easements replaces the prior dataset, DFG Owned and Operated Lands, which included only fee title lands and some operated lands (wildlife areas, ecological reserves, and public/fishing access properties that are leases/agreements with other agencies and that may be publicly accessible). This is a generalized version dataset that has a shorter attribute table than the original and also has been dissolved based on the fields included. Please note that some lands may not be accessible due to the protection of resources and habitat. It is recommended that users contact the appropriate regional office for access information and consult regulations for CDFW lands in Sections 550, 550.1, 551, 552, 630 and 702. For information on public use regulations on Department lands, please refer to the Public Uses on State and Federal Lands section of the Waterfowl, Upland Game, and Public Use Regulations booklet for both statewide and property-specific regulations https://wildlife.ca.gov/Regulations. All visitors are responsible for knowing and following the general and property-specific regulations.

    The CDFW Lands dataset is a digitized geographical inventory of selected lands owned and/or administered by the California Department of Fish and Wildlife. Properties such as ecological reserves, wildlife areas, undesignated lands containing biological resource values, public and fishing access lands, and CDFW fish hatcheries are among those lands included in this inventory. Types of properties owned or administered by CDFW which may not be included in this dataset are parcels less than 1 acre in size, such as fishing piers, fish spawning grounds, fish barriers, and other minor parcels. Physical boundaries of individual parcels are determined by the descriptions contained in legal documents and assessor parcel maps relating to that parcel. The approximate parcel boundaries are drawn onto U.S. Geological Survey 7.5'-series topographic maps, then digitized and attributed before being added to the dataset. In some cases, assessor parcel or best available datasets are used to digitize the boundary. Using parcel data to adjust the boundaries is a work in progress and will be incorporated in the future. Township, range, and section lines were based on the U.S. Geological Survey 7.5' series topographic maps (1:24,000 - scale). In some areas, the boundaries will not align with the Bureau of Land Management's Public Lands Survey System (PLSS). See the "SOURCE" field for data used to digitize boundary.

    Description

    The USGS Protected Areas Database of the United States (PAD-US) is the nation's inventory of protected areas, including public open space and voluntarily provided, private protected areas, identified as an A-16 National Geospatial Data Asset in the Cadastral Theme (http://www.fgdc.gov/ngda-reports/NGDA_Datasets.html). PAD-US is an ongoing project with several published versions of a spatial database of areas dedicated to the preservation of biological diversity, and other natural, recreational or cultural uses, managed for these purposes through legal or other effective means. The geodatabase maps and describes public open space and other protected areas. Most areas are public lands owned in fee; however, long-term easements, leases, and agreements or administrative designations documented in agency management plans may be included. The PAD-US database strives to be a complete “best available” inventory of protected areas (lands and waters) including data provided by managing agencies and organizations. The dataset is built in collaboration with several partners and data providers (http://gapanalysis.usgs.gov/padus/stewards/). See Supplemental Information Section of this metadata record for more information on partnerships and links to major partner organizations. As this dataset is a compilation of many data sets; data completeness, accuracy, and scale may vary. Federal and state data are generally complete, while local government and private protected area coverage is about 50% complete, and depends on data management capacity in the state. For completeness estimates by state: http://www.protectedlands.net/partners. As the federal and state data are reasonably complete; focus is shifting to completing the inventory of local gov and voluntarily provided, private protected areas. The PAD-US geodatabase contains over twenty-five attributes and four feature classes to support data management, queries, web mapping services and analyses: Marine Protected Areas (MPA), Fee, Easements and Combined. The data contained in the MPA Feature class are provided directly by the National Oceanic and Atmospheric Administration (NOAA) Marine Protected Areas Center (MPA, http://marineprotectedareas.noaa.gov ) tracking the National Marine Protected Areas System. The Easements feature class contains data provided directly from the National Conservation Easement Database (NCED, http://conservationeasement.us ) The MPA and Easement feature classes contain some attributes unique to the sole source databases tracking them (e.g. Easement Holder Name from NCED, Protection Level from NOAA MPA Inventory). The "Combined" feature class integrates all fee, easement and MPA features as the best available national inventory of protected areas in the standard PAD-US framework. In addition to geographic boundaries, PAD-US describes the protection mechanism category (e.g. fee, easement, designation, other), owner and managing agency, designation type, unit name, area, public access and state name in a suite of standardized fields. An informative set of references (i.e. Aggregator Source, GIS Source, GIS Source Date) and "local" or source data fields provide a transparent link between standardized PAD-US fields and information from authoritative data sources. The areas in PAD-US are also assigned conservation measures that assess management intent to permanently protect biological diversity: the nationally relevant "GAP Status Code" and global "IUCN Category" standard. A wealth of attributes facilitates a wide variety of data analyses and creates a context for data to be used at local, regional, state, national and international scales.     This data set was collected to create a comprehensive platform to visualize SWP owned land. The parcels were created from record parcel information displayed on Department CAD maps known as “Property Management Maps”. This CAD data was then converted to a compatible GIS source and imported as parcels. Each parcel displays the pertinent information regarding the Departments ownership rights and the time that it was acquired or granted. This data set was created to improve the efficiently of accessing and organize the departments land records.

    This service depicts National Park Service tract and boundary data that was created by the Land Resources Division. NPS Director's Order #25 states: "Land status maps will be prepared to identify the ownership of the lands within the authorized boundaries of the park unit. These maps, showing ownership and acreage, are the 'official record' of the acreage of Federal and non-federal lands within the park boundaries. While these maps are the official record of the lands and acreage within the unit's authorized boundaries, they are not of survey quality and not intended to be used for survey purposes." As such this data is intended for use as a tool for GIS analysis. It is in no way intended for engineering or legal purposes. The data accuracy is checked against best available sources which may be dated and vary by location. NPS assumes no liability for use of this data. The boundary polygons represent the current legislated boundary of a given NPS unit. NPS does not necessarily have full fee ownership or hold another interest (easement, right of way, etc...) in all parcels contained within this boundary. Equivalently NPS may own or have an interest in parcels outside the legislated boundary of a given unit. In order to obtain complete information about current NPS interests both inside and outside a unit’s legislated boundary tract level polygons are also created by NPS Land Resources Division and should be used in conjunction with this boundary data. To download this data directly from the NPS go to https://irma.nps.gov Property ownership data is compiled from deeds, plats, surveys, and other source data.     This dataset seeks to encapsulate right of way parcel information for the Los Angeles County Flood Control District(LACFCD). It contains polygons representing each parcel and attribute information information that lists the basic identification information of those parcels. There is also information on the underlying right-of-way map that the parcel polygon and attributes are based on--with a link to that map in the Land Records Information Website.This data is maintained by the Right of Way Section of the Survey/Mapping and Property Management Division of the Department of Public Works. It is drawn to be coincident with the county's landbase linework and thus may not be a true representation of a parcel's boundary.     Category EL3 easements relate to towing and walking easements (inner navigation), i.e. * Walking easements: The riparian properties of a watercourse or a federal lake are encumbered on each bank by a 3,25 metre easement, known as a walkway easement. This easement prohibits riparian landowners from planting trees or closing by hedges or otherwise. * Towing easements: Easement in respect of federal watercourses where there is a tow or operating road of interest to the navigation service. The easement strikes the properties in a space of 7.80 meters wide along the edges of these federal watercourses, as well as on the islands where it is needed. Riparian owners may not plant trees or close by hedges or otherwise only at a distance of 9.75 metres on the edges where there is a towing or operating path. * Servitudes for the use of fishermen: On the encumbered lands there are walk and tow easements, a so-called “fisherman’s use” easement. Article L2131-2 of the CGPPP provides that “Any owner, tenant, farmer or holder of a right in rem, riparians of a watercourse or a federal lake shall be required to leave the land encumbered by that walkway for the use of the manager of that watercourse or lake, fishermen and pedestrians.” By decision of the administrative authority, the right referred to in the preceding subparagraph may exceptionally be abolished either for reasons of general interest or for safety reasons where the banks are included in industrial establishments.     Public utility easements (SUPs) are administrative limitations on the right to property, they are established for the benefit of public persons, concessionaires of public works or public works, private persons engaged in an activity in the public interest. The collection and conservation of public utility easements is a sovereign task of the State, which must bring them to the attention of local and regional authorities so that they may annex them to their urban planning documents. The public utility easements concerned are those defined by Articles L. 126-1 and R. 126-1 of the Urban Planning Code and their annexes. T2 type easements are linked to the possibility for manufacturers and operators of a passenger cable car and declared to be of public benefit: — a right to establish an easement over unbuilt, unclosed land from a height of 50 metres. The easement is applicable over a width corresponding to the right-of-way of the line. — the right to remove from any obstacle or vegetation an area of strictly sufficient width and not more than 4 metres above the line and up to the level of the ground, in order to facilitate the installation, removal and maintenance of cables.
