North Oakville Zoning By-law 2009-189 is the comprehensive zoning by-law applying to all properties north of Dundas Street and south of Highway 407. It is the rule book controlling how land and buildings are used, the location of buildings on a lot, building heights, and other provisions necessary to ensure proper development. It was created as part of the planning process for North Oakville to implement the North Oakville Secondary Plans. Remaining lands in Oakville are covered by Zoning By-law 2014-014.
Zoning By-law 1984-63 was the town's main comprehensive zoning by-law for properties south of Dundas Street and north of Highway 407. It was repealed and replaced by Zoning Bylaw 2014-014, which was passed by Council on February 25, 2014 and partially deemed in force by the Ontario Municipal Board (OMB) on February 23, 2015. Additional sections of Zoning By-law 2014-014 have since been deemed in force. Certain properties and regulations in Zoning By-law 2014-014 remain subject to appeals. While those appeals remain active, selected provisions of Zoning By-law 1984-63 remain in effect. As such, compliance with the relevant provisions of both Zoning By-law 1984-63 and Zoning By-law 2014-014 will be required until the related appeals are disposed of by the Ontario Municipal Board. Applicants who do not comply with one or both by-laws will require relief from those by-laws.
