    This ethnographic project aims to examine criminalizing and illegalizing processes targeting pro-migration activists and other citizens (e.g. volunteers, practitioners) in Morocco and France. The study investigates the competing ways in which ‘crimes of solidarity’ mobilise discourses and practices of solidarity, citizenship, and illegality in Morocco and France. The data collection examines how state repression of pro-migration activists and other ‘citizens’, who are often conflated with smugglers and accused of aiding irregular migrants, sheds light on the shifting and contested legal, moral and political boundaries between ‘irregular migrants’ and ‘citizens’. The recent focus on the figure and experience of ‘the migrant’ has enriched scholarly engagements with the construction of migrant illegality, irregular migrant political agency, and the entanglements of humanitarianism and security. Our project expands these conversations by exploring how migration politics target and affect not just migrants but also citizens. This shift is necessary in order to examine the far-reaching bordering practices and contested politics of exclusion beyond inter-state boundaries and the precarious lives of irregular migrants. We investigate how migration politics in France and Morocco are shifting the political agency and subjectivity of citizens who face (the threat of) prosecution from state authorities at the border and beyond.

    This has been achieved through participant observation and informal interviews with activists, artists, community leaders, NGO practitioners, funders, and other relevant professionals in Morocco and France. Themes discussed during conversations included : participants’ opinions about the politics of migration in Morocco/France; their history of activism and other engagement around migration; the motivations behind their engagement; the difficulties and obstacles they have faced in their activities and engagement over migration etc.

    The project has generated original insights into how hostile migration politics that selectively manage, stop, deter, and control forms of mobility also target individuals and organisations providing forms of support, assistance, aid to migrant people. The project has shed light on how state authorities in France and Morocco deploy indirect, opaque, and insidious forms of harassment to intimidate ‘subversive solidarity actors’: citizens engaging in acts of solidarity with migrant people who publicly or covertly engage in a critical stance on migration control policies and practices. This research emphasises the importance of taking the policing of solidarity actors into account to understand the policing of migration more broadly, detailing how the racist and gendered policing of migrant people bleeds into the disciplining of those who support them.

    While attention to citizen solidarity has focused on European countries, the phenomenon is also visible in countries south of the Mediterranean. Spectacular trials have made the headlines. Our research findings shed light on the workings of less spectacular modes of criminalisation that target solidarity workers in the intimacy of their everyday lives, threatening their sense of security through opaque surveillance, attacks on their emotions, employment prospects and family life. We conceptualise this mode of criminalisation as ‘insidious harassment’, examining the entanglement of geopolitics, emotions, and the intimate at these migration pressure points. Without decentring migrants as the primary targets of violent bordering, it broadens our understanding of these regimes by drawing attention to the ways in which they viscerally target those who work to protect the rights of migrant people. The project’s findings highlight how forms of criminalisation range widely, from the explicit and physical to the intimate and psychological; from the formal to the informal, the banal to the spectacular.

    The findings reveal that states invest considerable resources - money, human resources (official & unofficial) and time - in seeking to inflict a sense of constant surveillance and discomfort on solidarity actors. Many of the people we spoke to suspected that these indirect and opaque forms of state violence represent a way to protect the appearance and reputation of these states as rights-respecting, while in fact they pursue a dedicated campaign of trying to harass migrant people and those who support them into submission. The effects of insidious harassment are multiple: they are financial, administrative, emotional, psychological, physical and sometimes legal. Beyond just impacting practices of solidarity, they work to target solidarity actors on a moral and on practical levels, with repercussions on their work, family and social lives. This constitutes a protracted and everyday pressure that often works to disrupt solidarity actors’ sense of safety within and trust of the authorities and nation state. However, achieving an overview and in-depth understanding of these modes of policing and how they play out may contribute to reducing these effects. This research project has also shed light on how in contexts where repression is constantly squeezed and solidarity actors face damaging state practices, their commitment to rectifying social injustices and wrongs is also galvanised.

    This is an Official Statistics bulletin produced by statisticians in the Ministry of Justice, Home Office and the Office for National Statistics. It brings together, for the first time, a range of official statistics from across the crime and criminal justice system, providing an overview of sexual offending in England and Wales. The report is structured to highlight: the victim experience; the police role in recording and detecting the crimes; how the various criminal justice agencies deal with an offender once identified; and the criminal histories of sex offenders.

    Providing such an overview presents a number of challenges, not least that the available information comes from different sources that do not necessarily cover the same period, the same people (victims or offenders) or the same offences. This is explained further in the report.

    Victimisation through to police recording of crimes

    Based on aggregated data from the ‘Crime Survey for England and Wales’ in 2009/10, 2010/11 and 2011/12, on average, 2.5 per cent of females and 0.4 per cent of males said that they had been a victim of a sexual offence (including attempts) in the previous 12 months. This represents around 473,000 adults being victims of sexual offences (around 404,000 females and 72,000 males) on average per year. These experiences span the full spectrum of sexual offences, ranging from the most serious offences of rape and sexual assault, to other sexual offences like indecent exposure and unwanted touching. The vast majority of incidents reported by respondents to the survey fell into the other sexual offences category.

    It is estimated that 0.5 per cent of females report being a victim of the most serious offences of rape or sexual assault by penetration in the previous 12 months, equivalent to around 85,000 victims on average per year. Among males, less than 0.1 per cent (around 12,000) report being a victim of the same types of offences in the previous 12 months.

    Around one in twenty females (aged 16 to 59) reported being a victim of a most serious sexual offence since the age of 16. Extending this to include other sexual offences such as sexual threats, unwanted touching or indecent exposure, this increased to one in five females reporting being a victim since the age of 16.

    Around 90 per cent of victims of the most serious sexual offences in the previous year knew the perpetrator, compared with less than half for other sexual offences.

    Females who had reported being victims of the most serious sexual offences in the last year were asked, regarding the most recent incident, whether or not they had reported the incident to the police. Only 15 per cent of victims of such offences said that they had done so. Frequently cited reasons for not reporting the crime were that it was ‘embarrassing’, they ‘didn’t think the police could do much to help’, that the incident was ‘too trivial or not worth reporting’, or that they saw it as a ‘private/family matter and not police business’

    In 2011/12, the police recorded a total of 53,700 sexual offences across England and Wales. The most serious sexual offences of ‘rape’ (16,000 offences) and ‘sexual assault’ (22,100 offences) accounted for 71 per cent of sexual offences recorded by the police. This differs markedly from victims responding to the CSEW in 2011/12, the majority of whom were reporting being victims of other sexual offences outside the most serious category.

    This reflects the fact that victims are more likely to report the most serious sexual offences to the police and, as such, the police and broader criminal justice system (CJS) tend to deal largely with the most serious end of the spectrum of sexual offending. The majority of the other sexual crimes recorded by the police related to ‘exposure or voyeurism’ (7,000) and ‘sexual activity with minors’ (5,800).

    Trends in recorded crime statistics can be influenced by whether victims feel able to and decide to report such offences to the police, and by changes in police recording practices. For example, while there was a 17 per cent decrease in recorded sexual offences between 2005/06 and 2008/09, there was a seven per cent increase between 2008/09 and 2010/11. The latter increase may in part be due to greater encouragement by the police to victims to come forward and improvements in police recording, rather than an increase in the level of victimisation.

    After the initial recording of a crime, the police may later decide that no crime took place as more details about the case emerge. In 2011/12, there were 4,155 offences initially recorded as sexual offences that the police later decided were not crimes.     In December 2020 HM Inspectorate of Constabulary and Fire and Rescue Services (HMICFRS), the College of Policing (CoP) and the Independent Office for Police Conduct (IOPC) published a report in response to the super-complaint submitted by Liberty and Southall Black Sisters about the practice of the police sharing of victims’ information with the Home Office.

    The report made recommendations for the police, the Home Office, the National Police Chiefs’ Council, and police and crime commissioners (or equivalents) to ensure victims of crime are always treated as victims first and foremost, regardless of their immigration status. The report also included actions for HMICFRS and the College of Policing regarding their own work.     The report included two actions for the College of Policing, as well as a role supporting the implementation of one of the recommendations to other bodies.

    Recommendation 1.

    The College was instructed to “immediately develop guidance”  to support those working in policing to fulfil ‘Recommendation 1’ – i.e. that “pending the outcome of recommendation 2, where officers only have concerns or doubts about a victim’s immigration status, we recommend that they immediately stop sharing information on domestic abuse victims with Immigration Enforcement.”

    The guidance has been produced and has been published as an update to existing ‘Authorised Professional Practice’ (APP) for policing. APP is authorised by the College of Policing as the official source of professional practice on policing. Police officers and staff are expected to have regard to APP in discharging their responsibilities.

    The revised guidance is in the ‘risk factors and vulnerabilities connected with domestic abuse’ section of the ‘Major Investigation and Public Protection’ APP.     Action 1.

    The action was for the College to “work with interested parties to consider how domestic abuse risk assessment tools used by the police and partner organisations can include immigration status as a risk factor.”

    The College has developed a revised risk assessment tool for domestic abuse, ‘DARA’, which focuses on uncovering evidence of coercive and controlling behaviour. There is evidence that the tool is more effective at eliciting disclosures of coercive and controlling behaviour. The potential use of immigration status as a way to manipulate and control would be addressed through use of the tool.

    Action 2.

    The action was for the College, “when updating knowledge and training products, ensure that the messaging across all relevant guidance is consistent about the need for policing to balance the needs for safeguarding a victim or witness against the national interest in investigating crime.”

    This is a continuing piece of work. Every revision of College of Policing training or guidance includes consideration of the balance between the rights of all involved and the necessity to achieve the best outcomes for all.

    Description

    How do dominant-group natives react to immigrants' political integration? We argue that ethnic minority immigrants winning political office makes natives feel threatened, triggering animosity. We test this dynamic across the 2010--2019 UK general elections, using hate crime police records, public opinion data, and text data from over 500,000 regional and local newspaper articles. While past work has not established a causal relationship between minorities' political power gains and dominant group animosity, we identify natives' hostile reactions with a regression discontinuity design that leverages close election results between immigrant-origin ethnic minority and dominant-group candidates. We find that minority victories increase hate crimes by 67%, exclusionary attitudes by 66%, and negative media coverage of immigrant groups by 110%. Consistent with power threat and social identity theories, these findings demonstrate a strong and widespread negative reaction---encompassing a violence-prone fringe and the mass public---against ethnic minority immigrants' integration into majority settings.

    Description

    This dataset lists inmates incarcerated at Cockatoo Island prison in Sydney (Australia) between 1847-1869. It offers insights into how the colonial criminal justice system operated after New South Wales’ transition from a penal colony to a ‘free’ colony when transportation ceased in 1840. It is a useful tool for genealogists tracing the lives of their criminal ancestors and for historians of crime and punishment researching nineteenth-century Australia. The dataset includes prisoners' names and aliases, their ship of arrival, place of origin, details of their colonial conviction(s) (trial place, court, offence, sentence), date(s) admitted to Cockatoo Island, and when and how they were discharged from Cockatoo Island. In some cases, it also includes prisoners' place of origin, occupation, biometric information (height, eye/hair colour, complexion, scars, tattoos), 'condition upon arrival' (convict or free), and (for convicts) details of their original conviction in Britain or Ireland. As a UNESCO World Heritage 'Convict Site' Cockatoo Island is best known as a site of secondary punishment for recidivist convicts, especially those transferred from Norfolk Island. This dataset demonstrates the diversity of the prison population: including nominally free convicts (ticket-of-leave holders), migrants from Britain, China and other Australian colonies drawn in by the gold rush, exiles from Port Phillip, Aboriginal Australians convicted during frontier warfare, colonial-born white Australians (including bushrangers), and black, Indian and American sailors visiting Sydney. Significant attention has been paid to the more than 160,000 British and Irish convicts who were transported Australia as colonists between 1787 and 1868. Much less has been said about those punished within the criminal justice system that arose in the wake of New South Wales' transition from 'penal' to 'free' colony (Finnane, 1997: x-xi). Cockatoo Island prison opened in 1839, a year before convict transportation to New South Wales ceased, and was intended to punish the most recidivist and violent of the transported convicts. This archetype has prevailed in historical discourses, and they have been described as 'criminal lunatics... [and] criminals incapable of reform' (Parker, 1977: 61); 'the most desperate and abandoned characters' (O'Carrigan, 1994: 64); and people of 'doubtful character' (NSW Government Architect's Office, 2009: 29). Yet, this was far from the truth. My analysis of 1666 prisoners arriving between 1839-52 show they were overwhelming non-violent offenders, tried for minor property crimes at lower courts. They were also far more diverse population than commonly recognised, including Indigenous Australian, Chinese and black convicts alongside majority British and Irish men (Harman, 2012). This project will make publicly available extremely detailed records relating to Cockatoo Island's prisoners to show people firsthand exactly who made up the inmate population. The digital version of the original registers will include information on convicts' criminal record, but also their job, whether they were married or had children, and even what they looked like. It will also be a name-searchable database so family historians can search for their ancestors, who may have been incarcerated on the island. As it stands, they will be able find information online about ancestors who were transported as long as they remained in the 'convict system', but they may seem to disappear as soon as they are awarded their ticket-of-leave and become 'free'. However, many former convicts, and free immigrants, to New South Wales were convicted locally, and these records can give us information about their lives within the colony. The type of data included in these registers will also allow researchers to investigate questions including: (1) were convicts more likely to offend again than free immigrants? (2) Were the children of convicts more likely to offend than others? (3) Did the influx of mostly Chinese migrants during the gold rush actually lead to a crime-wave, as reported in the press? (4) Were laws introduced between 1830 and 1853, actually effective at prosecuting bushrangers (highwaymen)? (5) Was the criminal-judicial system in Australia more rehabilitative, despite developing out of a harsher convict transportation system? Alongside the dataset, the website will include 'life-biographies' of individual convicts to show you how this dataset can be used to piece together a life-story. It also to warns against understanding a real-life person only through the records of their conviction. There many of fascinating stories to tell, including those 'John Perry' ('Black Perry') the prizewinning boxer; the love story of the 'Two Fredericks'; and Tan, the Chinese gold-digger who resisted his incarceration. In addition, there will be teaching resources for secondary school children and undergraduate university students who want to engage directly with historical materials, without having to leave their classroom. Overall, this website invites anyone with an interest in the history of crime and punishment, and any visitors to the UNESCO world heritage site 'Cockatoo Island', to try searching for a name in the database or read about a featured convict's life story. It asks them, though, to think about how and why these people's lives intersected with the state, leading to their incarceration, and how history has erased much of their lives outside of it. Data collection involved photographing a Cockatoo Island’s surviving prison registers and returns kept at the State Archives of New South Wales (call numbers: 4/4540, 4/6501, 4/6509, 6571, 4/6572, 4/6573, 4/6574, 4/6575, X819). In these volumes, clerks had listed details of incoming prisoners on the dates they arrived between April 1847 and October 1869. This prison register for the period 1839-46 (call number: 2/8285) had not survived to a good enough quality for accurate transcription and was excluded from data collection. I photographed and then transcribed these records in full into a tabular form, with minor standardisation of abbreviations and irregular spellings. Where multiple records existed for one person I combined information from two separate archival records into one line of the dataset. Where I could not verify that two people with the same name were the same person, I listed them as separate entries. Barring errors in entry at the time of record creation, the studied population represents the entire population of prisoners incarcerated at Cockatoo Island between April 1847 and October 1869 when the prison closed.

    This paper uses nationally representative, longitudinal data to examine experiences and fear of ethnic and racial harassment in public spaces among minorities in the UK, comparing levels of both before and after the 2016 EU Referendum. We do not find an increase in the prevalence of ethnic and racial harassment, but we do find higher levels of fear of ethnic and racial harassment in the period after the Referendum. The increase in fear following the vote was concentrated among more privileged individuals: those with higher levels of education, and those living in less socioeconomically deprived areas with lower levels of previous right-wing party support. We conclude that the Referendum exacerbated already higher levels of perceived discrimination among higher educated minorities while reducing the buffering effect of residence in “safe areas.”
